Sellers Terms & Conditions

These Sellers Terms & Conditions govern the relationship between MisterETec and any person or entity that registers as a seller on misteretec.com (the "Platform"). They apply in addition to our Terms of Use, Seller Fee & Policy, Packaging Guidelines, Shipping Policy and Cancellation & Returns Policy. By listing a product on the Platform you accept these terms.
1. Our role
MisterETec operates the Platform as an intermediary / marketplace under the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020. The contract of sale for a marketplace listing is between the Seller and the Buyer. MisterETec provides the storefront, order management, payment collection, logistics coordination and customer support, but is not the seller of record for third-party listings.
2. Eligibility and onboarding
- Sellers must be legally competent to contract and must be registered to do business in India.
- The following must be provided and kept current: legal entity name and constitution, GSTIN (or a valid exemption declaration), PAN, bank account details with a matching name, a pickup address, and a working phone number and email.
- MisterETec may verify any document and may refuse, pause or withdraw onboarding where verification fails.
- Each Seller may hold one active account unless MisterETec approves additional accounts in writing.
3. Listings and product information
- Listings must be accurate, complete and not misleading: correct title, brand, model, images of the actual product, specifications, country of origin, net quantity, and mandatory declarations under the Legal Metrology Act.
- The Seller must hold the rights to every image and description uploaded.
- Manufacturer / packer / importer details, expiry or best-before information and warranty terms must be disclosed where applicable.
- Prohibited: counterfeit or replica goods, unauthorised refurbished goods sold as new, stolen goods, recalled goods, items infringing a trade mark or copyright, hazardous or restricted items, and anything unlawful to sell in India.
- MisterETec may edit, deactivate or delist any listing that is inaccurate, non-compliant, unsafe or the subject of a valid complaint.
4. Price, MRP and taxes
- Sellers set their own selling price. Any MRP shown must be the genuine declared MRP for that exact product — inflated or fictitious MRP is a material breach.
- Prices must be inclusive of GST. The Seller is responsible for charging the correct rate and HSN.
- The Seller must issue a valid GST tax invoice in the Buyer's name with every order and include it in the parcel.
- The Seller is responsible for its own GST, TCS and TDS compliance and filings.
5. Inventory, dispatch and Express Delivery
- Stock and availability must be kept accurate at all times. Persistent overselling leads to penalties and suspension.
- Orders must be packed as per the Packaging Guidelines and handed over within the dispatch window shown in the seller dashboard.
- For Express Delivery, the Seller must keep shift availability, live inventory and contact details current, hand over sealed parcels, and verify the rider before handover.
- Unjustified cancellations by the Seller, late handovers and pickup failures are tracked and affect the Seller's performance score.
6. Returns, replacements and refunds
- Sellers must honour the return and replacement windows published in the Cancellation & Returns Policy for the relevant category.
- Returns caused by seller error — wrong item, missing item, damaged in transit due to inadequate packaging, item not as described, or counterfeit — are at the Seller's cost, including forward and reverse logistics.
- Where the Seller does not respond to a return request within the timeline shown in the dashboard, the request may be resolved in the Buyer's favour.
- MisterETec may refund a Buyer directly and recover the amount from the Seller's settlement where the Buyer Protection Program applies.
7. Fees, settlement and payouts
Fees, deductions, settlement cycles and payout conditions are set out in the Seller Fee & Policy, which forms part of these terms. All applicable fees are visible in the seller dashboard before they are charged. MisterETec may withhold or set off a payout against confirmed dues, refunds, penalties, chargebacks or amounts under investigation.
8. Performance standards
Sellers are measured on order defect rate, cancellation rate, late dispatch rate, return rate attributable to the Seller, and response time to customer and support queries. Falling below the published thresholds may result in reduced visibility, loss of Express Delivery eligibility, listing deactivation or account suspension.
9. Intellectual property and brand protection
- The Seller grants MisterETec a non-exclusive, royalty-free licence to use listing content, brand names and images for the purpose of displaying, marketing and fulfilling orders on and off the Platform (including in advertising and product feeds).
- The Seller warrants it has the right to sell the branded goods it lists and to use the marks shown.
- MisterETec operates a notice-and-takedown process. Valid infringement or counterfeit complaints lead to immediate delisting and may lead to permanent removal of the Seller.
10. Confidentiality and data protection
Buyer data shared with the Seller may be used only to fulfil the order, handle returns and meet legal obligations. It must not be used for independent marketing, must not be sold or shared, and must be kept secure. Sellers must not include any material in a parcel that directs the Buyer away from the Platform.
11. Indemnity and limitation of liability
The Seller indemnifies MisterETec, its officers and employees against any claim, loss, penalty or cost arising from the Seller's products, listings, tax position, statutory non-compliance, intellectual-property infringement or breach of these terms. To the extent permitted by law, MisterETec's aggregate liability to a Seller is limited to the fees received from that Seller in the three months preceding the claim. MisterETec is not liable for indirect or consequential loss, including loss of profit or goodwill.
12. Suspension and termination
- Either party may terminate the seller relationship with 30 days' written notice.
- MisterETec may suspend or terminate immediately for counterfeit goods, fraud, statutory breach, safety risk, repeated performance failure, or misuse of Buyer data.
- On termination the Seller must fulfil all confirmed orders and honour all open returns. Settlements may be held for up to 90 days to cover returns, refunds and chargebacks.
13. Grievance redressal
Seller grievances should first be raised through seller support with the order or reference number and supporting evidence. If it is not resolved, escalate to the Grievance Officer named on our Contact Us page. We acknowledge grievances within 48 hours and aim to resolve them within one month, in line with the Consumer Protection (E-Commerce) Rules, 2020.
14. Governing law and jurisdiction
These terms are governed by the laws of India. The courts at New Delhi shall have exclusive jurisdiction.
15. Changes to these terms
MisterETec may amend these terms. Material changes are notified through the seller dashboard or by email and apply prospectively. Continuing to list after the effective date constitutes acceptance.
